(B) Conditional Uses: ... The following are conditional uses in the AR district, permitted only when authorized by the planning commission: ... 20. Invalid or invalid caretaker secondary housing. A secondary independent living unit on a lot or parcel already developed to the maximum density allowed in the district, for the housing of an invalid family member or a caretaker of an invalid family member residing in the primary residence on the parcel, subject to the following: (a) The dwelling may be attached or detached from the primary residence. A mobile home may not be attached to the primary residence. (b) The floor area of the secondary dwelling may not exceed that of the primary dwelling. Full Breakdown
In the AR Agricultural-Residential district, a single-family dwelling not to exceed one unit on each parcel is the permitted residential use under § 4-2-3(A). A second dwelling arrives only through conditional use item 20 of § 4-2-3(B), which the Planning Commission authorizes. The item covers invalid or invalid caretaker secondary housing: a secondary independent living unit on a lot or parcel already developed to the maximum density allowed in the district, for the housing of an invalid family member or a caretaker of an invalid family member residing in the primary residence on the parcel.
Four conditions attach. Under (a), the dwelling can be attached or detached from the primary residence, but a mobile home may not be attached to the primary residence. Under (b), the floor area of the secondary dwelling cannot exceed that of the primary dwelling. Under (c), the conditional use permit must be reviewed within two years and every two years thereafter. Under (d), a mobile structure must be removed when it is no longer used for invalid or invalid caretaker housing, and an attached or conventionally constructed unit where removal is impractical cannot be used as rental housing.
The A Agricultural-Recreational district carries the same item as conditional use 12 of § 4-2-4(B). The code also defines a GUESTHOUSE in § 4-1-9 as a detached accessory building with living quarters for temporary guests of the occupant, and it lists one guesthouse per parcel as a conditional use in the OS district and the A district. A guesthouse can contain a kitchen or cooking facilities. This code applies only in unincorporated Elko County. Elko, Carlin, Wells and West Wendover regulate secondary dwellings under their own codes.
Violations & Fines
A secondary dwelling built or used outside the conditional use terms is a use contrary to the zoning title. Section 4-9-14(A) declares it a public nuisance that the District Attorney can move to abate, and § 4-9-14(B) makes the violator guilty of a misdemeanor, with a fine of not more than $1,000, jail of not more than six months, or both. Each day is a separate offense.
