Section 537, adopted November 19, 2025 to implement Arizona HB 2928, allows one attached and one detached ADU on any residentially zoned lot. Standard maximum size is 1,000 square feet with 5-foot side and rear setbacks.
Under Section 537, every residentially zoned lot in unincorporated Yavapai County may have one attached and one detached ADU in addition to the primary single-family dwelling. The standard ADU size cap is 1,000 square feet of livable area. Parcels of one acre or more may add one more detached ADU under county standards. Setbacks are 5 feet for side and rear yards. Arizona state law bars the county from requiring extra parking for the ADU itself, but parking removed from the primary residence must be replaced. The Board added language requiring adequate sewer or septic capacity before approval.
Building an ADU without a permit or in violation of Section 537 is a zoning violation. Code Enforcement issues stop-work and notice. Continued non-compliance can lead to civil penalties and a Class 2 misdemeanor citation.
