Full Breakdown

Sec. 37-628(c) is the only Detached ADU combination the code allows: a Detached ADU cannot be paired with any accessory structure other than a detached garage. When an ADU is built in or alongside a detached garage, the two floor areas are tracked separately, the ADU square footage counts against the ADU size cap (600 or 800 square feet, per Sec. 37-628(b)), and the garage square footage counts against the general accessory-structure aggregate cap in Sec. 37-222; in no case can the combined ADU floor area exceed the ADU size allowance.

Sec. 37-628(f)(3) then addresses converting an older garage outright: if a homeowner establishes a Detached ADU in an existing detached accessory structure, whether by combining with it or by fully converting the structure into the ADU, and that structure was originally built more than ten years before the ADU building-permit application, and it does not meet the current setback standards required for a principal structure in the district, the Detached ADU is exempt from those setback standards. The same exemption covers new construction of a Detached ADU built on the foundation of a qualifying ten-year-old accessory structure.

The exemption is not a license to expand the nonconformity, however: the existing encroachment into the setback cannot be increased or extended by the new Detached ADU. All other ADU performance standards, the 24-foot height cap, one-per-lot limit, two-person occupancy cap, ban on home occupations, and building-permit requirement, still apply to a garage-converted ADU.
