Summary

Tacoma allows homeowners to convert an existing garage or other accessory structure into a legal dwelling unit without meeting current setback, height or location standards, as long as it meets Building Code.

Conversion of existing accessory structures to residential use. Permitted or legally nonconforming accessory structures, existing as of February 1, 2025, in a UR or an R district may be converted to a dwelling unit regardless of conformance to setback, location, maximum height, or other development regulation. The building must be brought into compliance with current Building Code requirements and required pedestrian access shall be provided.

5. Use Standards, subject to variance:

a. Minimum lot size. Attached and Detached ADUs are permitted on any legally established lot, irrespective of lot size or width, provided that applicable size, location, setback, amenity space, and other standards are met.

b. ADU size.

(1) The habitable area of ADUs, excluding any garage area and other non-living areas, shall be limited to a maximum of 1,000 square feet.

c. Height. The ADU, whether attached or detached, does not have a maximum height limit in and of itself. Instead, the height provisions of the zoning district and the applicable housing type within which the ADU is incorporated shall control the maximum height. In View Sensitive Districts, the maximum height of any Backyard Building containing one or two ADUs shall be the same as that of the primary structure, as defined in TMC § 13.06.070A.

Full Breakdown

Tacoma Municipal Code § 13.06.080A.4.i lets any permitted or legally nonconforming accessory structure standing as of February 1, 2025 in a UR or R district, including a detached garage, be converted into a dwelling unit regardless of its conformance to setback, location, maximum height, or other development regulation. The converted building must be brought into compliance with current Building Code requirements and provide required pedestrian access; the resulting unit counts toward the two accessory dwelling units allowed per lot.

Violations & Fines

Converting without a building permit and City inspection bypasses the Building Code and zoning/minimum-and-maximum-size review Tacoma requires before occupancy, exposing the owner to code-enforcement action.

Frequently Asked Questions

Do I need a permit to convert my garage?
Yes. Tacoma requires a building permit application to Planning and Development Services and a City inspection before the conversion is legal.
Do I need to replace the parking I lose?
No. Tacoma's ADU rules do not require off-street parking, and it is permitted to remove existing parking to site the conversion.
