Summary

A shed in unincorporated Cherokee County is regulated as an accessory structure under Zoning Ordinance Section 5.6. It cannot exceed 25 feet in height, its footprint is capped at 50 percent of the house's gross square footage, and it must stay at least ten feet off any side or rear line. Table 5.4 also limits how many accessory structures, sheds included, a lot may hold, from three down to one depending on the zoning district.

Full Breakdown

6-3 lists 'a garage, shed or building for domestic storage' as a permitted accessory use in every residential and AG district. That shed is then governed by the general accessory-structure standards in the same section. 1A. Subsection C caps height at 25 feet, or the height of the house itself if that is lower. Placement is controlled by subsection A: a shed cannot sit closer to the side or rear lot line than ten feet, though 'a two foot overhang for eves or gutters will be permitted within this ten foot setback,' and where a district's or plat's setback is already less than ten feet, the less restrictive standard applies instead.

A shed generally cannot be placed closer to the front lot line than the house, unless the lot is at least two acres, in which case it must still meet the front building setback and cannot block the view of the house from the street. Sheds of 400 square feet or more, or any shed placed forward of the principal structure, must be built of exterior materials 'complimentary to and compatible with the principal structure,' such as cementitious siding, masonry, or wood siding, unless the planning and zoning director approves an exception.

4 separately limits the number of accessory structures per lot, from three in the AG (platted), R-80, R-60 and R-40 districts down to two in R-30 through R-15, and just one in RD-3 and RZL, though homes, pools and tennis courts are excluded from that count.

Violations & Fines

An oversized, mislocated, or unpermitted shed is enforced as a Zoning Ordinance violation under Section 19.1. The Planning and Zoning Department can issue a written notice of violation, and conviction carries a fine of up to $1,000.00 or 60 days in jail per offense, with each additional day of noncompliance treated as a separate offense and injunctive relief available to force removal.

Frequently Asked Questions

How big can a storage shed be in unincorporated Cherokee County?
Section 5.6(B) caps a shed's gross floor area at 50 percent of the principal house's gross square footage, and Section 5.6(C) limits height to 25 feet or the height of the house, whichever is lower. Sheds under 200 square feet don't count toward the lot's overall lot coverage limit.
How close to my property line can I put a shed?
At least ten feet from any side or rear lot line under Section 5.6(A), with a two-foot allowance for roof overhangs. It generally cannot sit closer to the front lot line than the house unless your lot is two acres or larger.
How many sheds or accessory structures can I have?
Table 5.4 sets a limit by zoning district, from three accessory structures in AG, R-80, R-60 and R-40 down to just one in the RD-3 and RZL districts. Homes, swimming pools and tennis courts are not counted against that limit.
