In unincorporated Hamilton County, a detached shed or accessory building cannot cover more than a third of the rear yard and must stay at least five feet off the side and rear lot lines. Zoning Regulations Section 103.E gives small 12-by-12-foot storage buildings looser eave-height and setback rules, but anything larger, or built after the house, needs its own permit from the Building Commissioner.

City-specific rules exist: Chattanooga has its own shed & carport rules rules that differ from Hamilton County's county-level regulations. If you live in Chattanooga, check the city-specific page instead.

E. Location of Accessory Buildings on a Lot (1) A detached accessory building shall not occupy more than 1/3 of the area of a rear yard. ... (5) No detached accessory building shall be erected, altered or moved so as to be within five feet of the side line of the front half of an adjacent lot. ... (8) Small storage buildings, not larger than twelve feet by twelve feet (12' x 12') and with a maximum height to the low point of the eaves of six feet (6'), may be located in the side and rear yards provided that: (a) The buildings shall be set back at least five (5) feet from the side and rear lot lines and (b) In the case of a corner lot, the accessory building may not project into the side yard adjacent to the street.

Full Breakdown

E, 'Location of Accessory Buildings on a Lot,' governs where a detached shed, garage or other accessory building can sit once you clear the district's main setback lines; it applies only in the unincorporated county, since Article IX excludes Chattanooga and the county's other incorporated towns. A detached accessory building cannot occupy more than one-third of the area of a rear yard. On a corner lot, no accessory building may be erected, altered or moved nearer than one-third of the lot's depth or width to the front or side street line, and on any lot no accessory building can come within five feet of the side line of the front half of an adjacent lot.

The section also caps how far back a shed has to sit: notwithstanding the other rules, no detached accessory building has to be set more than 75 feet from any street bounding the lot. Small storage buildings get a specific exception in subsection (8): a building no larger than 12 feet by 12 feet, with a maximum height of six feet to the low point of the eaves, can go in the side or rear yard if it sits at least five feet off the side and rear lot lines, and on a corner lot does not project into the side yard next to the street.

Article VIII, Section 102 treats an accessory building built at the same time as the main house as covered by that single building permit, but a shed added later needs its own separate permit from the Hamilton County Building Commissioner through the Department of Building Inspection.

Violations & Fines

Building or moving an accessory structure in violation of Section 103.E is a misdemeanor under Article VIII, Section 105.B, punishable by a fine of $25 to $100, with each day the violation continues treated as a separate offense. The Building Commissioner, acting through the Department of Building Inspection, can withhold or revoke the permit, and Section 105.C authorizes the county to seek an injunction or abatement order requiring the shed to be moved or removed.

Frequently Asked Questions

How big can I build a shed on my property in unincorporated Hamilton County without extra rules?
A small storage building up to 12 feet by 12 feet, with a maximum eave height of six feet, can go in the side or rear yard under Section 103.E(8) as long as it sits at least five feet from the side and rear lot lines and, on a corner lot, stays out of the street-side yard.
How close to my property line can a shed sit?
At least five feet from the side and rear lot lines for a small storage building under Section 103.E(8), and five feet from the side line of the front half of an adjacent lot for a larger detached accessory building under Section 103.E(5). A detached accessory building also cannot cover more than one-third of the rear yard.
Do I need a permit for a shed in Hamilton County?
Yes, unless it was built at the same time as the main house's permit. Article VIII, Section 102 covers accessory buildings built alongside the main structure under that one permit, but any accessory building added afterward, including most sheds, needs its own separate permit from the Building Commissioner's Department of Building Inspection.
