"Dangerous Dog" is defined at San Diego County Code § 62.601(l) as a dog that has twice within 48 months attacked, bitten, or otherwise injured a person engaged in lawful activity; that has once caused death or substantial injury; or that has previously been declared "Vicious" or "Dangerous." Carlsbad's own code confirms that dangerous-dog hearings, unlike other animal hearings under Chapter 1.10, are administered directly by the animal control authority (§ 7.08.015(D)). The declaration process starts when the department serves notice of intent to declare a dog dangerous, explaining the underlying incidents; the owner has five business days to request a hearing, and failing to request or attend one results in an automatic declaration (§ 62.674(a)(2)-(4)).

Once declared, the department may impose conditions including $100,000 in liability insurance, specific enclosure size and construction, muzzling or restraint requirements, a separate Dangerous Dog registration on top of the ordinary license, mandatory spay/neuter, and a right to inspect the dog and its enclosure (§ 62.674(a)(6)a-i), or may impound and destroy the dog outright. It is independently unlawful to possess a declared Dangerous Dog unless it is restrained, confined, or muzzled so it cannot bite (§ 62.674(e)). An owner may seek departmental administrative review of an adverse decision within five business days, and if that review upholds destruction, the owner may apply for a writ of mandate from Superior Court within another five business days before the dog can be destroyed (§ 62.684(d)).
