These county ordinances apply to unincorporated areas of Onslow County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)It shall be unlawful for any person to permit any dog to be at-large upon any public property or street, sidewalk, park, or on the private property of another person without his/her consent.(b)Provided sufficient precautions are taken by the owner to ensure the safety and protection of both the public and other animals, a dog will not be considered at-large if:(1)The dog is under the direct control of its owner; or(2)The dog is engaged for purposes of hunting; or(3)The dog is engaged for purposes of an obedience demonstration, show, trial training exercise, competition, or another educational program; or(4)The dog is subject to enclosure using an electronic confinement system, if all equipment is properly worn, utilized, and maintained in continuous working order.(c)The penalty for a violation of this section shall be as set forth in section 4-29 of this chapter.

Section 4-11 of the Onslow County Code of Ordinances prohibits any dog from being at-large upon public property, streets, sidewalks, parks, or the private property of another person without that person's consent. The county's definition of "at large" in section 4-3(10) means the animal is not on the owner's property and not under immediate, continuous physical control by fence, cord, chain or other restraint. Four exceptions keep a dog from being cited as at-large: it is under the owner's direct control, it is hunting, it is engaged in an obedience demonstration, show, trial, training exercise, competition or educational program, or it is confined by a properly worn and maintained electronic confinement system.

Cats are exempt from the separate leash-restraint provision in section 4-9(2), but the at-large prohibition in section 4-11 applies to dogs. Onslow County Animal Services investigates complaints and impounds loose dogs under section 4-21; a dog not reclaimed within the 72-hour holding period becomes county property and may be adopted, fostered, transferred or humanely euthanized. Owners who reclaim a dog must pay impoundment and daily maintenance fees regardless of whether the dog was picked up for a violation, surrender, or quarantine. This section applies only within Onslow County's unincorporated area; Jacksonville, Swansboro, Richlands and Holly Ridge enforce their own leash ordinances as separate municipal jurisdictions.

Violations & Fines

A first at-large citation under section 4-29 carries a $50 civil penalty; a second offense within 12 months is $100; a third or subsequent offense within 12 months is $250, with each day of continued violation charged as a separate offense. The animal services director may waive a civil penalty at his or her discretion. Any violation also constitutes a misdemeanor under G.S. 14-4, and the county may pursue equitable remedies under G.S. 153A-123.
