It shall be unlawful for any pet shop, rescue organization, animal foster care organization, commercial animal facility, groomer, breeder, kennel, stable or animal "day care" business to fail to:(a)Maintain and retain records for a two-year period on all animals maintained in such facility. Such records shall show breed, color, markings, sex and age; date received and source...date and disposition of animal...Such records shall be made available to the Supervisor of Animal Control upon request for inspection;(b)Provide cages and pens constructed of nontoxic, easily cleanable, water-impervious materials if used for confining animals and shall keep such cages and pens clean and sanitary at all times;(f)Provide each animal with sufficient space to stand up, lie down and turn around in a natural position without touching the sides or top of the enclosure...(k)Maintain the premises of such business...in a clean and sanitary condition in compliance with the health standards set forth in this chapter.(l)Comply with all provisions of the Unified Zoning Code. Any individual who fails to comply with the requirements of this section shall be deemed guilty of a misdemeanor.

Food must be free of contamination and sufficient for the animal's size and condition, fresh water must be available at all times except during a veterinary treatment regimen, and the business must provide veterinary care to maintain the animal's health. 04 health standards for domestic animal structures, covering cleaning frequency, rodent control and waste storage, and subsection (l) requires compliance with the Wichita-Sedgwick County Unified Zoning Code, meaning a groomer also needs the correct commercial zoning before opening.

Sec. 6.04.176 has no listed fine in the Chapter 6.04 penalty table, so the general Sec. 6.04.190(a) misdemeanor applies: a fine of not more than $2,500, imprisonment of not more than one year, or both.
