South Fulton Code Title 18 limits the number of dogs and cats in two ways. First, Sec. 18-1004(a)(4) ('Unlawful housing of domestic animals and livestock') caps the maximum number of dogs and cats at 10 per single premises outside areas zoned for agriculture (with exceptions for licensed veterinary hospitals, commercial kennels, grooming parlors, and public/commercial horse facilities). Sec. 18-1004 also requires a minimum of 100 square feet of space for dogs and cats and a 100-foot setback from occupied buildings where three or more cats or dogs are kept. Second, Sec. 18-3001 ('Special permits') provides that any premises where four or more dogs over four months old are kept, maintained, or harbored for 14 days or longer is deemed a kennel; the owner or occupant must apply to the city manager or the contracted animal control provider for a special permit (plus any other required permits). The special permit is issued upon paying an annual fee and showing the premises and dogs meet the title's requirements, is valid one year, and individual license tags are issued for each kennel dog. Commercial kennels subject to a business license fee are exempt from the annual special permit fee. These provisions were adopted by Ord. No. 2019-007. Note that all dogs and cats over four months must also maintain current rabies vaccination (Sec. 18-2001).
Keeping more than the allowed number of dogs or cats, or operating an unpermitted kennel of four or more dogs, is unlawful (Sec. 18-1004, 18-3001). Violations can lead to impoundment (Sec. 18-1010) and penalties under the City Charter (Sec. 18-1002).
