Appleton, WI Animal Ordinances: Pet Store Rules (2026)

Adopted as Ordinance 15-521 and effective July 1, 2021, §3-25 bans the retail sale chain for dogs and cats at any pet store in the city, defined in subsection (a) as a retail establishment where companion animals are sold, exchanged, bartered or offered for sale to the public. Subsection (b) prohibits a pet store from selling, delivering, offering for sale, bartering, auctioning, giving away or otherwise transferring or disposing of a cat or dog. The ordinance carves out one narrow exception: a pet store may let an animal care facility or a 501(c)(3) animal rescue organization use its space to showcase adoptable dogs or cats, but only if the store takes no ownership interest in those animals and charges no fee for the space, and any dog showcased that way may not be kept at the store overnight.

The definitions distinguish a legitimate rescue, whose mission is placing animals in permanent homes, from a 'breeder' who maintains dogs or cats for the purpose of breeding and selling offspring, or a 'broker' who buys from a breeder for resale, closing off arrangements that would dress up a commercial breeding pipeline as an adoption partnership.
