Wausau bans pet stores from selling, bartering, or giving away any dog or cat under Wausau Municipal Code § 8.08.115, a "puppy mill" ordinance adopted in 2023. Stores may still host adoption events for shelters and rescues, but each animal sold in violation triggers a separate $500 civil penalty.

(c)Restrictions on the sale of animals. No pet store shall sell, deliver, offer for sale, barter, auction, give away, or otherwise transfer or dispose of animals. Nothing in this section shall prohibit pet stores from collaborating with animal care facilities or animal rescue organizations to offer space for such entities to showcase adoptable animals provided the pet store shall not have any ownership interest in the animals offered for adoption and shall not receive a fee for providing space for the adoption of any of these animals. Animals may not be kept overnight.(d)Penalty. A pet store that violates this section shall be subject to a civil penalty of $500.00, and each dog or cat offered for sale in violation of this section shall constitute a separate violation.

Full Breakdown

Adopted by Ord. No. 08 Animals after findings that most pet-store puppies and kittens trace back to large-scale commercial breeding operations with documented welfare and consumer-protection problems, including an antibiotic-resistant Campylobacter risk the CDC has linked to pet-store puppies. "Pet store" is defined as any retail establishment where animals are sold, exchanged, bartered, or offered for sale to the public, but the definition excludes animal care facilities (municipal or county-run shelters) and 501(c)(3) animal rescue organizations that are not themselves breeders or brokers. The operative rule bars a pet store from selling, delivering, offering for sale, bartering, auctioning, giving away, or otherwise transferring or disposing of any dog or cat.

A narrow carve-out lets a pet store host shelters or rescues in-store to showcase adoptable animals, provided the store takes no ownership interest in those animals, charges no fee for the space, and does not keep the animals overnight. The ban does not touch private breeders who sell directly to the public or licensed rescues and shelters operating on their own. Enforcement runs through the City Attorney's office on referral from the Humane Officer.

Violations & Fines

Each dog or cat offered, sold, or given away in violation of § 8.08.115 is a separate offense carrying a $500.00 civil penalty under § 8.08.115(d); a store found with several puppies for sale in one inspection can face stacked $500 penalties per animal, on top of any state consumer-protection exposure.

Frequently Asked Questions

Can a Wausau pet store still sell puppies or kittens?
No. Wausau Municipal Code § 8.08.115(c) bars any pet store from selling, bartering, auctioning, or giving away a dog or cat, full stop; the ban targets commercial breeding-mill supply chains, not the animals' overall availability in the city.
Can I still buy a dog directly from a breeder in Wausau?
Yes. The ordinance only restricts retail pet stores; § 8.08.115(a) states the rule "will not affect a consumer's ability to obtain a dog or cat...from an animal rescue, shelter, or breeder who sells directly to the public."
Can a pet store host an adoption event?
Yes, if it takes no ownership interest and charges no fee for space, under § 8.08.115(c); animals showcased for adoption may not be kept on the premises overnight, and the shelter or rescue organization remains the seller of record.
