Summary

In the City of Paramount, California, animal hospitals, kennels and veterinary offices are unclassified uses under Paramount Municipal Code § 17.40.010. Each one needs a conditional use permit processed under Chapter 17.48, and the code excludes them outright from the R-1, R-2, R-3, R-4 and C-3 zones. The Planning Commission decides, and the City Council hears appeals.

A. All of the following, and all matters related thereto, are declared to be uses possessing characteristics of such unique and special form as to make impractical their being included automatically in any classes of use as set forth in the various classifications defined in this chapter, and the authority for the location and operation thereof shall be subject to and permitted only after first obtaining a conditional use permit in the manner prescribed in Chapter 17.48, and is required by this section. ... 8. Animal hospitals, kennels and veterinary offices; except, that these uses are specifically excluded from the "R-1," "R-2," "R-3," "R-4" and "C-3" zones.

Full Breakdown

Chapter 17.40 of the Paramount Municipal Code lists uses that the City Council treated as too unusual to fit the ordinary zone classifications. Authority to locate and operate any use on the list is permitted only after first obtaining a conditional use permit in the manner prescribed in Chapter 17.48. Item 8 on the list names animal hospitals, kennels and veterinary offices, and the same item removes them from the R-1, R-2, R-3, R-4 and C-3 zones. No permit application can place a veterinary practice, a boarding kennel or an animal hospital in those districts in the City of Paramount.

The definitions in § 17.04.010 describe a small animal hospital or clinic as an establishment in which veterinary services, clipping, bathing, boarding and other services are rendered to dogs, cats and other small animals and domestic pets. Grooming and boarding sit inside that definition, so a pet groomer that also boards animals is reviewed the same way as a clinic.

Under § 17.48.020 the applicant must substantiate to the Planning Commission or City Council that the use will not adversely affect the health, peace, safety or welfare of people living or working nearby, that the site is adequate in size and shape for yards, walls, fences, parking and loading facilities and landscaping, that the streets serving it are wide enough for the traffic it generates, and that the use is necessary or desirable for the development of the community. The Planning Commission gives public notice under Chapter 17.56 and holds a hearing (§ 17.48.030). Not more than 30 days after the hearing ends it announces its findings by formal resolution, and a copy goes to the applicant within 14 days (§ 17.48.040). Within 10 days after receiving notice of the action, any aggrieved or interested person can appeal in writing to the City Council through the City Clerk, depositing one-half of the filing fee paid on the original application (§ 17.48.050).

Violations & Fines

Running a veterinary office, kennel or animal hospital without the permit, or in an excluded zone, violates Title 17. Under § 17.04.130 a violation is a misdemeanor punishable by a fine of not more than $300.00 or up to 90 days in the County Jail, or both. Each day is a separate offense, and any use maintained contrary to the title is a public nuisance. The City Manager or a designee is the enforcing agent, with appeals to the Planning Commission (§ 17.04.120).

Frequently Asked Questions

Can a veterinary clinic open in an R-1 zone in Paramount?
No. Section 17.40.010(C)(8) says animal hospitals, kennels and veterinary offices are specifically excluded from the R-1, R-2, R-3, R-4 and C-3 zones. The exclusion is written into the use list itself, so a clinic in those districts cannot be approved through the conditional use permit process.
What permit does a veterinary office need in the City of Paramount?
A conditional use permit, processed under Chapter 17.48. The applicant must show the Planning Commission or City Council that the use will not harm the health, peace, safety or welfare of nearby residents or workers, that the site is large enough, and that streets can carry the traffic it generates.
Does a grooming and boarding business count as a veterinary use?
The definition in § 17.04.010 for a small animal hospital or clinic covers veterinary services, clipping, bathing, boarding and other services rendered to dogs, cats and other small animals and domestic pets. A business offering those services together fits the definition, and kennels are named separately in § 17.40.010.
How long does Paramount take to rule on the permit, and who can appeal?
The Planning Commission announces its findings by formal resolution not more than 30 days after the public hearing ends. Any aggrieved or interested person can appeal to the City Council within 10 days after the applicant receives notice, by filing in writing with the City Clerk and depositing one-half of the original filing fee.
