Summary

Berkeley requires a building permit from the Building and Safety Division for most construction, alteration, and repair work, issued under Berkeley Municipal Code Section 19.28.020's adoption of the 2025 California Building Code. A short list of minor work is exempt, including small tool sheds under 120 square feet, fences under 7 feet, and low sidewalks, but nearly everything else needs a permit, a construction-document review, and a paid fee before work starts.

105.2 Work exempt from permit. Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following: Building:

1. One-story detached accessory structures used as tool and storage sheds, playhouses and similar non-occupiable uses, provided that the floor area does not exceed than 120 square feet (11.15 m2), there is an existing primary structure on site and no electrical, plumbing and/or mechanical systems are installed.

2. Fences, other than swimming pool barriers, not over 7 feet (2134 mm) high.

6. Sidewalks and driveways not more than 30 inches (762 mm) above adjacent grade, and not over any basement or story below and are not part of an accessible route.

Full Breakdown

2's list of the only work exempt from needing a building permit: specific small accessory structures under 120 square feet, fences under 7 feet (other than swimming pool barriers), certain retaining walls, small water tanks, low sidewalks and driveways, finish work like painting and tiling, and a handful of other narrow categories. 3: a written application on a Building and Safety Division form, identifying the work, describing the property, stating the intended use and occupancy, attaching construction documents, and stating the project's valuation, plus the applicant's signature.

2. 2. 1, effective January 1, 2019, though again the building official can grant 180-day extensions. A new permit, with new fees based on the remaining work, is required to finish anything that lapses.

Violations & Fines

Starting building, electrical, gas, mechanical, or plumbing work before the permit is issued triggers a penalty under Berkeley Municipal Code Section 19.28.020 (California Building Code Section 109.4): a fee equal to double the normal permit cost for the unpermitted portion of the work, charged in addition to the regular permit fee. The building official can also refuse to issue a permit outright whenever the work would put public safety at risk, under Section 105.8.

Frequently Asked Questions

What work is exempt from a Berkeley building permit?
A short list under Berkeley Municipal Code Section 19.28.020: one-story accessory sheds under 120 square feet with no utilities, fences under 7 feet other than pool barriers, retaining walls under 4 feet, small water tanks, low sidewalks and driveways, and finish work like painting, tiling, and cabinetry. Nearly everything else, from additions to new construction, needs a permit from the Building and Safety Division.
How long is a Berkeley building permit application valid before it expires?
365 days from filing if no permit has been issued, under Berkeley Municipal Code Section 19.28.020 (California Building Code Section 105.3.2). The building official can grant extensions of up to 180 days each on a written request showing justifiable cause, and an abandoned application is deemed expired, requiring a brand-new submission.
What if I start work before my Berkeley permit is issued?
The city charges a penalty fee equal to double the normal permit cost for the portion of the work done without a permit, on top of the regular permit fee, under Section 109.4 of the adopted California Building Code. That penalty applies to building, electrical, gas, mechanical, and plumbing work alike.
