Summary
Before the Bethel Building Official can approve an application to construct, reconstruct, alter, or otherwise modify a building or structure, § 42-3 requires proof the property's real estate taxes are current, under an approved payment plan, or that the work repairs fire or casualty damage. Bethel adopted the Connecticut Basic Building Code by reference in § 42-1 as its building code.
In addition to the other requirements contained in Chapter 42, no application to construct, reconstruct, alter or otherwise modify any building or other structure within the Town of Bethel shall be approved by the Bethel Building Official and no building permit shall be issued unless one of the following provisions is satisfied: (1) The property owner or his agent obtains from the Bethel Tax Collector and delivers to the Bethel Building Official a written statement that the real property taxes for the property upon which the building or other structure is located or proposed are paid to the date of application. ... (3) The property owner or his agent obtains from the Bethel Fire Marshal and delivers to the Bethel Building Official a written statement that the building for which the permit is requested has been damaged or destroyed by fire or other casualty loss and that the work for which the building permit is requested is necessary to repair said damage or to reconstruct said destroyed building.

Full Breakdown
Bethel's building permit chapter, Chapter 42, was adopted by Town Meeting on December 1, 1966, and incorporates the Connecticut Basic Building Code by reference under § 42-1, meaning construction, alteration, and demolition work in Bethel is governed by the state building code's technical standards rather than a separate local building code. Section 42-2 lets the Board of Selectmen set and change the fee schedule for building permits covering new construction, repairs, demolition, alterations, and remodeling. Added later, on September 9, 1996, § 42-3 layers an additional local prerequisite on top of the state code: the Bethel Building Official may not approve any application to construct, reconstruct, alter, or otherwise modify a building or structure, and may not issue the permit, unless the applicant satisfies one of three conditions.
The property owner must show the Bethel Tax Collector confirms current real property taxes are paid to the date of application, or show the Tax Collector has accepted a satisfactory payment agreement for past-due taxes with no default, or, for damage repair work, show the Bethel Fire Marshal has confirmed the building was damaged or destroyed by fire or other casualty and the requested permit covers necessary repair or reconstruction. In practice, a Bethel property owner who is behind on real estate taxes cannot pull a building permit for ordinary renovation work until the tax account is current or a payment plan is in place, though the fire-damage pathway lets owners rebuild after a casualty loss even while a tax dispute is unresolved. The section took effect on the 31st day after its adoption and publication.
Violations & Fines
Section 42-3 does not set a stand-alone fine; it works as a gate on permit issuance, and the Building Official simply refuses to approve the application or issue the permit until the tax-status or fire-damage condition is met. Building without a required permit elsewhere in Chapter 42 falls under the adopted Connecticut Basic Building Code's own enforcement provisions rather than a separate Bethel-set fine.
