Summary

Bethel's zoning regulations require every establishment needing off-street loading, including hospitals, hotels, restaurants and industrial uses, to reserve at least one space of 500 square feet, sized under a table in Zoning Regulations § 118-6.2F: one space up to 15,000 square feet of floor area, two spaces between 15,000 and 30,000 square feet, and one more space per additional 30,000 square feet.

Provision required. Loading space shall be provided for each establishment and shall be sufficient in size and arrangement to accommodate trucks of the type servicing the establishment. In the case of hospitals, institutions, hotels, restaurants, retail, wholesale and industrial uses, and wherever required by other uses, each loading space shall be a minimum of 500 square feet and loading spaces shall be furnished according to the following table: Required Off-Street Loading Space Gross Floor Area Number Of Spaces Up To 15,000 Sq. Ft. 1 15,000 To 30,000 Sq. Ft. 2 Each Additional 30,000 Sq. Ft. 1 ... In any case where an off-street loading space or spaces have been established, loading shall thereafter take place in such space or spaces in preference to any public street or sidewalk.

Full Breakdown

2F(1) sets the baseline: any use that needs loading, specifically naming hospitals, institutions, hotels, restaurants, retail, wholesale and industrial uses, must provide loading space 'sufficient in size and arrangement to accommodate trucks of the type servicing the establishment,' with each individual space at least 500 square feet. The required number scales with gross floor area under the table in that subsection: one space for buildings up to 15,000 square feet, two spaces from 15,000 to 30,000 square feet, and one additional space for every further 30,000 square feet beyond that.

Two companion rules matter for compliance. 2 cannot also serve as the loading space. 2F(4) requires that once a loading space exists on site, loading and unloading must happen there rather than in a public street or sidewalk, so a business cannot rely on curb loading once it has an approved bay. 2 once a certificate of zoning compliance issues.

Violations & Fines

A property that skips required loading space or converts it to parking is in violation of the Zoning Regulations. Under § 118-9.2C, the Zoning Enforcement Officer first orders abatement or correction, giving the owner 10 days to comply. A violation left uncorrected past that deadline becomes a separate offense for each day it continues, and any owner, lessee, tenant or contractor who commits or allows the violation is guilty of a misdemeanor under state law referenced at C.G.S. § 8-12.

Frequently Asked Questions

Does a small Bethel retail shop need a loading dock?
Yes, if it needs deliveries by truck. Section 118-6.2F(1) applies loading space requirements to retail uses along with hospitals, restaurants, wholesale and industrial buildings. A shop under 15,000 square feet of gross floor area needs one loading space at least 500 square feet, sized and arranged to fit the type of truck that services it.
Can a business use its required parking spaces for loading instead?
No. Section 118-6.2F(2) specifically states that parking spaces required under § 118-6.2 cannot be counted as loading or unloading space. A business must provide loading space in addition to, not instead of, its required off-street parking.
Can trucks load in the street if a business has an approved loading bay?
No. Once an off-street loading space is established, § 118-6.2F(4) requires that loading take place there in preference to any public street or sidewalk, so curb loading is not an option for a site with an approved bay.
What happens if a business ignores the loading space rule?
The Zoning Enforcement Officer orders correction under § 118-9.2C and allows 10 days to comply. Missing that deadline turns each additional day into a separate violation, and the responsible owner, lessee or tenant is guilty of a misdemeanor under C.G.S. § 8-12.
