Summary

In unincorporated Elko County, Nevada, building permits follow the I-codes and the 2018 Northern Nevada Amendments, with printed exclusions: agricultural structures under 400 square feet, accessory sheds under 200 square feet, and cosmetic remodeling valued under $5,000.

These county ordinances apply to unincorporated areas of Elko County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(A) Adoption of the 2018 Northern Nevada Amendments as modified are applicable to Elko County. 1. The following structures are excluded from the applicability of any permit requirements: (a) Agricultural structures not used for human habitation containing less than four hundred (400) square feet, when used for agricultural use as defined by NRS 361A.030. (b) All one-story detached accessory structures used as tool and storage sheds, animal shelters, play houses and similar uses, and not used for human habitation containing less than two hundred (200) square feet and not exceeding a 10 foot eave wall height. (IBC & IRC section 105.2.1.) (c) Non-structural cosmetic remodeling valued at less than five thousand dollars ($5,000.00), including material and labor, which does not change the existing floor plan or the use or occupancy of the structure.

Full Breakdown

Elko County Code § 3-1-4(A) adopts the 2018 Northern Nevada Amendments as modified, and paragraph 1 lists structures excluded from any permit requirement. First, agricultural structures not used for human habitation containing less than 400 square feet, when used for agricultural use as defined by NRS 361A.030. Second, all one-story detached accessory structures used as tool and storage sheds, animal shelters, play houses and similar uses, not used for human habitation, containing less than 200 square feet and not exceeding a 10 foot eave wall height, citing IBC and IRC section 105.2.1.

Third, non-structural cosmetic remodeling valued at less than $5,000 including material and labor, which does not change the existing floor plan or the use or occupancy of the structure. Fourth, sidewalks, driveways and uncovered decks not more than 30 inches above adjacent grade and not over any basement or story below, when the deck is not the primary exit from a residence. Private stairways of 30 inches or less in height can have a handrail on one side only. Agricultural hoop houses and high tunnels, used exclusively for live plants, are also excluded, but electrical, mechanical and sanitary plumbing installation in them is not exempt, and zoning rules can still apply.

For everything else, permit fees are set by resolution of the Board of Commissioners under § 3-1-4(A)(3) and § 3-1-5(A), with a plan review fee of thirty five percent of the building permit fee for a residential dwelling. Property in travel zones 1, 2 and 3 pays a travel fee of $20, $40 or $60. Section 3-1-4(A)(2) requires a certificate of occupancy before a building in groups A, B, E, F, H, I, M, R, S or U is used or occupied or its occupancy classification changes.

Under § 3-1-4(E), where a governmental entity or utility provides water or sewer service, no permit issues without evidence of paid connection fees. State Public Works Board projects still apply to the Building and Safety Division under § 3-1-4(F), without charge. No permit issues for hazardous waste facilities under § 3-1-6.

Violations & Fines

Building without a required permit, or contrary to an approved plan, is a misdemeanor under § 3-1-7: a fine of not more than $500, imprisonment for not more than six months, or both. Each ten days a violation continues is a separate offense when nothing else is specified, and a court can close, seal or impound the premises until it is corrected.

Frequently Asked Questions

Can I build a shed without a permit in unincorporated Elko County?
Yes, if it is a one-story detached accessory structure used as a tool or storage shed, animal shelter or play house, not used for human habitation, under 200 square feet and no higher than a 10 foot eave wall. Section 3-1-4(A)(1)(b) sets those limits, and zoning rules still apply separately.
Do I need a permit to remodel my kitchen?
Not for non-structural cosmetic remodeling valued at less than $5,000, including material and labor, that does not change the existing floor plan or the use or occupancy of the structure. Section 3-1-4(A)(1)(c) sets that exclusion. Work above that value or that changes the layout needs a permit.
Is a certificate of occupancy required?
Yes. Section 3-1-4(A)(2) says no building or structure in groups A, B, E, F, H, I, M, R, S or U can be used or occupied, and its occupancy classification cannot change, until the building official has issued a certificate of occupancy.
Where do I pay for the permit and plan review?
Permit fees are set by resolution of the Elko County Board of Commissioners, and the current resolution is at the Community Development office. A residential dwelling plan review costs thirty five percent of the building permit fee under § 3-1-4(A)(4), plus a travel fee of $20, $40 or $60 by zone.
