Full Breakdown

40(B) states plainly that a permit shall be obtained before beginning construction, alteration, repair, or placement of any building or structure, as required by the Zoning Ordinance of the county, with all permits issued by the Building Commissioner and fees paid to the County Planning and Building Department. 40(A) sets the application content: a plat or sketch showing lot boundaries, dimensions, easements, building setback requirements, water supply and sewage disposal systems, drainage systems, and street access, plus plans and specifications for the work. Applications for anything other than accessory and agricultural residential buildings need a plot plan certified by a state-registered land surveyor or engineer, along with foundation, floor, roof, and wall cross-section plans and electrical, plumbing, heating, ventilating, and air-conditioning layouts.

C. 22-15-3-1 must reach the county Building Commissioner before a permit issues. 40(D), permits are issued only after Plan Commission fees are paid in cash, check, credit card, or money order, and the Commissioner will not process an application until fees are paid in full. 41 then requires the Commissioner to review every application for subchapter compliance, for other required county or state permits, and, for sites in the floodplain, for flood-resistant construction materials and methods before any permit is granted.

Violations & Fines

Violating the building-permit requirement under § 150.40, or any other provision of §§ 150.35 through 150.49, is punishable under § 150.99(C) by a fine of not less than $10 nor more than $200, with each day of continued unpermitted work counted as a separate offense; § 150.47 separately makes it unlawful to construct, alter, or maintain a building contrary to the subchapter.
