Summary
Surry County adopts the North Carolina State Building Codes for all construction in unincorporated Surry County, and its zoning ordinance requires a valid zoning permit before any building permit can be issued. Excavating, constructing, moving, altering or repairing any building or accessory structure, or changing a land or building use, is unlawful until the Zoning Administrator issues that zoning permit, which is void after six months without substantial progress.
(A)(1) The North Carolina State Building Codes, as they may be amended, superseded or modified, including indexes and appendices thereto, are hereby adopted by Surry County and shall be enforceable within the county, including, but not limited to, the Building Code, Residential Code, Mechanical Code, Electrical Code, Plumbing Code, Administrative Code, Fuel/Gas Code, Energy Conservation Code, Existing Building Code and Fire Prevention Code. ... § 154.005-01 ZONING ADMINISTRATION. ... (C) Zoning permits. (1) A valid zoning permit shall be presented with any application for a building permit. No building permit shall be issued for any activity in a zoned area until such zoning permit is presented. (2) It shall be unlawful to commence the excavation for, or the construction of, any building or other structure including accessory structures; or to commence the moving, alteration or repair of any structures; or the use of any land or building, including accessory structures, until the Zoning Administrator has issued a zoning permit for such work or use including a statement that the plans, specifications and intended use of such land, or structures, in all respects conforms with the provisions of this chapter.
Full Breakdown
Section 150.01 adopts the North Carolina State Building Codes, including the Building Code, Residential Code, Mechanical Code, Electrical Code, Plumbing Code, Fuel/Gas Code and Fire Prevention Code, for the regulation and governing of the conditions and maintenance of all property, buildings and structures, and makes those codes enforceable throughout the county, including issuing permits and collecting fees. Before a building permit issues, though, §154.005-01(C) requires a separate, earlier step: a valid zoning permit shall be presented with any application for a building permit, and no building permit shall be issued for any activity in a zoned area until such zoning permit is presented.
The same subsection makes it unlawful to begin excavation, construction, moving, alteration or repair of any building or accessory structure, or to change a land or building use, until the Zoning Administrator has issued a zoning permit confirming the plans and intended use conform to the zoning ordinance. Applications go to the Zoning Administrator on county forms, and a zoning permit expires six months after issuance unless substantial progress has been made on the project. Separately, under §154.005-06 and G.S. § 160D-1111, a building permit itself lapses six months after issuance if work has not begun, and no further work may occur under a lapsed permit until it is renewed.
Once construction is done, §154.005-03 requires a certificate of occupancy from the Building Inspector or Zoning Administrator before any new, altered or repurposed building may be occupied, issued automatically after final inspections confirm compliance.
Violations & Fines
Building or using property without the required zoning or building permit is a violation under §154.005-10, enforceable by the Zoning Administrator or a Code Enforcement Officer through §154.005-11's civil penalty schedule: a warning citation giving 15 days to correct, then $50 for a first citation, $100 for a second, and $100 for each further citation for the same offense, with each day of continued violation a separate offense; the county may also seek a court injunction or order of abatement.
