(a)Building Permits. A building permit shall be required for the following types and classes of activities. Electrical, plumbing, and mechanical work is not covered by a building permit and, if such work is to be performed, separate permits shall be obtained and the applicable fees shall be paid. No building permit shall be issued unless and until a certificate of zoning compliance, as required by this Code, has been obtained from the zoning administrator. Fees for building permits shall be as follows:(1)For new construction finished or unfinished (including additions). Type Fee Residential structures under roof $0.17 per square foot with a minimum fee of $90
Full Breakdown
The fee schedule under § 7.1-8(a)(1) scales by use: commercial structures under roof pay $0.015 per square foot for the first 30,000 square feet and $0.13 per square foot beyond that, while structures not under roof, such as patios, decks, ramps and loading docks, pay $0.15 per square foot with a $90 minimum. Electrical, plumbing and mechanical work is carved out of the building permit entirely and needs its own permit and fee. A $5 technology fee applies to nearly every permit type to cover software costs.
A permit becomes invalid under § 7.1-9(c) if work is not started within six months of issuance or is suspended for six months, and new detached single-family dwellings and additions to them must finish within a three-year window from issuance under § 7.1-9(d). Owners of the single-family home they live in may do their own additions, alterations or repairs without hiring a licensed contractor, but they still must pull every required permit and pass all inspections before using the completed work, per the general lead-in to § 7.1-8. Starting work before the permit issues doubles the fee under § 7.1-8(h)(1), capped at an extra $250.
Violations & Fines
Building without the required permit, or in violation of an approved plan or a building code official's directive, is unlawful under § 7.1-59, as is continuing work after a stop-work order except to correct the violation. Conviction carries a fine up to the maximum permitted by § 36-106 of the Code of Virginia, with each day of continued violation a separate offense, on top of the doubled permit fee for unpermitted starts.
