Section 154.041 sets up the R-1 Residential District, the town's low-density residential zone, and subsection (B) lists the uses allowed there by right. Child day-cares, nurseries, and after-school care facilities sit at item (B)(5), and unlike most of the other permitted uses on the list, this one carries its own built-in condition: the facility must have 'an adequate fenced-in outdoor play area.' The word 'adequate' is not defined with a number in this section, so it is applied case by case by the Administrative Official who reviews the permitted use, working alongside R-1's other district-wide dimensional standards.

Those standards still apply to a day-care like any other building in the district: § 154.041(C) sets the minimum lot area at 8,000 square feet, minimum lot width at 50 feet, minimum front yard at 30 feet, minimum side yards of at least ten feet each (15 feet if a side yard abuts a street), and a minimum rear yard of 15 feet, and § 154.041(D) caps building height at 35 feet unless the yards are enlarged to match any additional height. A day-care's fenced play area also has to respect the district's rules on accessory structures and yard encroachments under § 154.041(E) through (G) if it includes any structure or falls in a required yard.

Because the condition is written directly into the permitted-use list rather than as a separate licensing chapter, a day-care that opens in R-1 without a fenced outdoor play area is not merely non-compliant with a minor detail, it fails the very use listing that makes the facility a lawful use of the property at all.
