Full Breakdown

The Jacksonville Beach Code treats sprinklers as a supplemental local requirement, adopted under § 10-3.16 to further the growth management goals of the Jacksonville Beach Comprehensive Plan. Subsection (1) applies to new buildings and existing buildings incorporating new additions or expansions, except one- or two-family dwellings. The triggers are an occupant load of three hundred (300) persons or more; an assembly occupancy above or below the level of exit discharge regardless of occupant load; use as an educational, health care, ambulatory health care, or residential board and care occupancy; any area below the level of exit discharge; all buildings over seven thousand (7,000) square feet of gross floor area of all floors combined; and all buildings over four (4) stories regardless of gross floor area.

Section 10-3.02 supplies the definitions. A complete automatic sprinkler system means one described in NFPA No. 13, NFPA No. 13D and NFPA No. 13R. Gross floor area is measured within the inside perimeter of the outside walls with no deduction for hallways, stairs, closets, thickness of interior walls, columns, or other features. New additions or expansions mean altering a building to increase occupancy usable floor space or the number of living units, or remodeling or renovation equal to or exceeding the cumulative total of fifty (50) percent of the assessed value of the structure, measured before the work started or, for a damaged structure being restored, before the damage occurred.

Subsection (2) lets the fire official omit sprinkler heads in electrical or telephone equipment areas not over one hundred (100) square feet, and in small compartmented areas such as closets not over twenty-four (24) square feet and bathrooms not over fifty-five (55) square feet with limited or non-combustible walls and ceilings that extend behind fixtures. Subsection (3) requires electronic supervision to detect water flow, at a location approved by the fire official and constantly attended by a competent person trained and equipped to alert the fire department.

Violations & Fines

Failure to comply with the fire chapter or any lawful order of the fire official is a misdemeanor of the second degree under § 10-3.12(a), punishable by a fine of not more than $500.00, or imprisonment for not more than ten (10) days, or both, and each day is a separate offense. The city can also seek an injunction or mandamus under § 10-3.12(b) or use the special magistrate process of Chapter 2, Article VI. Under § 10-3.17, no construction permit issues before the fire official approves the plans.
