Section 151.08 requires the permit holder to notify the Building Commissioner when work is ready for inspection and bars moving past any inspection point without the Commissioner's approval. Required inspections run in sequence by category: underground, footing, foundation, framing and final for structures; rough-in and final for plumbing; and comparable staged checks for electrical, mechanical and energy work.

These county ordinances apply to unincorporated areas of Elkhart County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Full Breakdown

08(A) puts the burden on the person doing the permitted work to notify the Building Commissioner once it is ready for inspection, and on the owner, contractor or requester to provide safe, unobstructed access into the structure without special arrangements: no ramps or ladders are allowed, and at minimum temporary steps must be in place. No work may proceed past the point covered by a given inspection until the Building Commissioner approves that inspection. Subsection (B) lays out the required inspection sequence by construction category.

Structures need underground, footing, foundation, framing and final inspections. Plumbing needs rough-in and final inspections. Electrical work needs temporary service, permanent and rough-in service, and final inspections. Mechanical work needs rough-in, covering chimney and duct work, and final inspections. Energy work, inspected pre-drywall, covers mechanical, plumbing, insulation and gas service in that pass. 09. C. C. 36-7-8-9 requires 15 days' written notice by registered mail to the County Commissioners stating the grievance.

Violations & Fines

Proceeding with construction beyond an inspection point without the Building Commissioner's approval, or failing to provide safe access for a scheduled inspection, is a County Building Code violation under § 151.99(A)(1), carrying a civil penalty of up to $2,500 per violation and treating each day of continued violation as a separate offense.

Frequently Asked Questions

Who has to schedule building inspections?
The person doing the permitted work must notify the Building Commissioner when it is ready for inspection under § 151.08(A). The owner, contractor or person requesting the inspection also has to provide safe, unobstructed access, with at least temporary steps in place; ramps and ladders aren't accepted.
What inspections does plumbing work require?
Two inspections in sequence under § 151.08(B): a rough-in inspection before the work is closed up, and a final inspection once it's complete. Energy inspections, done pre-drywall, also check plumbing along with mechanical, insulation and gas service work.
Can I appeal a building inspector's order in Elkhart County?
Yes. Section 151.09 lets an aggrieved person appeal to the state Fire Prevention and Building Safety Commission under I.C. 22-13-2-7, or to court under I.C. 36-7-8-9, though a court appeal requires 15 days' written notice by registered mail to the County Commissioners.
