If an Illinois Department of Public Health (IDPH) or local health department mitigation notice has been issued under Section 9 of the Act, the owner must give written notice to all prospective lessees that a lead hazard was previously identified, unless a certificate of compliance has been obtained. Property owners cannot retaliate against a tenant for reporting a suspected lead hazard. (3) Local: Peoria Code Chapter 5, Article VI (adopting the 2018 IPMC) treats peeling, flaking, or deteriorated paint in pre-1978 housing as a property maintenance violation under IPMC Sections 304.2 and 305.3, citable independently of any tested lead level. The Peoria City/County Health Department investigates children with elevated blood-lead levels under IDPH protocols and can order inspections and abatement.
Federal disclosure violations under 42 U.S.C. 4852d can result in civil penalties up to $19,507 per violation (2025 dollars), treble damages to affected tenants/buyers, and HUD/EPA enforcement actions. EPA RRP rule violations can result in penalties up to $52,393 per day per violation. Illinois Lead Poisoning Prevention Act violations are misdemeanors under 410 ILCS 45/13 with civil penalties also available.
