A related limit governs rear-yard additions: per the handout and Chapter 19.320, a rear-yard addition may encroach to within 5 feet of the rear property line provided rear-yard coverage (in the rear 25 feet) does not exceed 30 percent. Landscaping is also required: a minimum of 50 percent of each required yard abutting a street must be permanently maintained with landscaping per the City handout (the draft code states 30 percent), and water-efficient landscaping rules apply. The 40-percent lot-coverage cap is a Buena Park zoning standard; it is not set by the California Building Code.
Building or expanding so that covered structures exceed 40 percent of net lot area, or so that a rear-yard addition exceeds the 30-percent rear-yard coverage allowance, violates Buena Park Municipal Code Chapter 19.316 (and Chapter 19.320 for rear-yard additions). Enforcement includes denial of plan check or permit final, required redesign or removal of excess coverage, administrative citations, and code-enforcement penalties. Exceeding the cap requires a variance.
