Lot-coverage compliance is checked at the time of building-permit application via plot plan and again at field inspection by the Construction Department.
Exceeding the lot-coverage maximum under Chapter 37 is a zoning violation; the Construction Code Official will not issue a Certificate of Occupancy until the parcel is brought into compliance. Code Enforcement can issue fines up to $1,250 per offense under Chapter 1 Β§1-5. Failure to comply with NJ DEP stormwater requirements at N.J.A.C. 7:8 may trigger separate NJDEP enforcement on larger projects.
