California Government Code Β§65852.2 preempts county setbacks for ADUs β detached ADUs only need 4-foot side and rear setbacks regardless of the underlying zone. Variances are reviewed by the Zoning Administrator or Planning Commission depending on magnitude. Flood-prone parcels in the Delta face additional freeboard requirements.
