Placing a building, addition, or accessory structure within a required setback without an approved variance or exception is a zoning violation enforceable by the County. The Building & Construction division will not approve plans that encroach into setbacks, and unpermitted encroachments can trigger stop-work orders, notices of violation, denial of final inspection, and orders to relocate or remove the structure. A formal variance through Planning is generally needed to build closer than the minimums.
