Margate, FL Building Setbacks & Zoning: Structure Height Limits (2026)

Margate caps residential heights by district in the Land Development Code. In the R-3 district, § 40.512(E) provides that one- and two-family dwellings cannot exceed thirty-five (35) feet, while buildings for all other permitted uses cannot exceed four (4) stories or fifty (50) feet. The R-1 dimensional table in § 40.510(C) lists a height of 35 feet on every line from R-1 through R-1D, and its footnote marks the height column as a maximum. Non-residential structures in R-1 also top out at thirty-five (35) feet under § 40.510(F), with one exception: a steeple or tower on a Place of Assembly can extend to fifty (50) feet.

R-2 follows the same rule in § 40.511(E): no building or structure, or part of one, can be erected or altered above thirty-five (35) feet, except a Place of Assembly steeple or tower up to fifty (50) feet. Height also drives other standards. In R-3, side setbacks are fifteen (15) feet or one-half the building height, whichever is greater, and the front setback is twenty-five (25) feet or a depth equal to the height of the building, whichever is greater. A multiple-dwelling structure over twenty-five (25) feet tall needs a site with two hundred (200) feet of street frontage and one (1) acre, while one at or under twenty-five (25) feet needs 100 feet of width, 100 feet of depth and 10,000 square feet. Non-residential side setbacks in R-1 grow by one foot for every two feet of height over twenty feet.
