Margate, FL Parking Rules: Driveway Rules (2026)

Driveways and parking surfaces are governed by Section 40.705, Off-street Parking, Loading, and Driveways, plus Chapter 26 for recreational vehicles. Under 40.705(A)(6), vehicles can be parked only in spaces meeting the code's design standards, and parking in drive aisles and loading zones is prohibited. Off-street parking facilities, including access aisles and driveways, must be surfaced with a minimum of 1 inch of asphaltic concrete over a 6-inch limerock base and maintained in a smooth, well-graded condition. Subsection (F) bars using required parking areas, landscaped areas, swales, parkways, traveled rights-of-way and sidewalks for parking, repair or storage of inoperative or unregistered vehicles, boats or trailers, except in an emergency and for not longer than 48 hours.

Subsection (O) sets driveway geometry for driveways constructed or modified after the article took effect. Single-family driveways need an 18-inch side setback, a 5-foot rear setback, 20 feet between connections on the same lot, and a hardened driveway approach of concrete, asphalt or brick paver that is at least as wide as the driveway at the property line. Circular driveways need a landscaped area between connections and must be set back at least 8 feet at the midpoint. Lots with 54 feet of frontage or less get a maximum of two driveways with a total width of 27 feet on the primary frontage. Wider lots get up to three driveways totaling 60 per cent of the frontage, not less than 27 feet. Vehicles are prohibited from driving over curbs and sidewalks not built for vehicular traffic.

For counting required spaces, a single-width driveway must be 20 feet deep and 9 feet wide for one vehicle. Section 26-3(a)(4) adds that a noncommercial recreational vehicle is parked only in backyards or side yards so that no portion protrudes past or in front of the residence's facade, except in a driveway or area constructed and permitted by the building department.
