Full Breakdown

UDO Sec. 4-53 sets the county's siting standards for sexually oriented businesses, which the use table allows only via Special Use Permit in commercial, industrial and Sp. Purpose districts. A site must sit at least 2,000 feet from any other sexually oriented business and at least 2,000 feet from any church, school, childcare home or center, residence, or ABC-licensed establishment, plus at least 1,000 feet from any Residential or RMH district boundary. No other principal use may share the building or lot.

Violations & Fines

Operating a sexually oriented business without an approved Special Use Permit, or within the required 1,000- or 2,000-foot buffers, is a zoning violation subject to enforcement by the Wake County Planning Department.
