Fairfield, CT Business Licensing & Operations: Adult Entertainment (2026)

Chapter 40A, the Adult-Oriented Establishments Ordinance, adopted by the Representative Town Meeting in 1996, regulates bookstores, motion-picture theaters and any premises offering adult entertainment through booths, cubicles or studios. Section 40A-4 sets three separate distance rules: no site within 500 feet of land zoned residential, none within 500 feet of a preexisting residential dwelling, public or private school, place of worship, public library or public park, and none within 1,000 feet of an existing adult-oriented establishment. The same section bans enclosed viewing booths outright, requiring that any room used for viewing adult entertainment be well lit, with overhead fixtures providing at least one footcandle of illumination at floor level, continuously open to view from the common areas and never blocked by doors, curtains, partitions or drapes.

Operators must keep minors out of the premises, including adjacent parking lots, and must open the establishment to inspection at all reasonable times by the Fairfield Police Department, Town inspectors, or other persons designated by the RTM. Definitions in § 40A-3 make clear the ordinance targets adult bookstores, adult motion-picture and mini motion-picture theaters and adult amusement machines featuring specified sexual activities or specified anatomical areas, while § 40A-2 states an intent not to restrict protected speech or the content of otherwise lawful materials. An operator is legally responsible for an employee's violations if committed with the operator's knowledge or approval, or through the operator's negligent failure to supervise.
