Fairfield, CT Noise Ordinances: Aircraft Noise (2026)

Chapter 41, Aircraft, adopted by the Representative Town Meeting in 1984, makes it unlawful under § 41-1 for any passenger or freight-carrying airplane, helicopter or other FAA-registered aircraft to take off or land anywhere in the Town of Fairfield. The chapter carves out only three exceptions: emergencies, use by federal, state or local government officials exercising governmental responsibilities, and public-purpose flights authorized by a permit from the Chief or Acting Chief of Police. Section 41-2 requires the Chief to confirm both a valid public purpose and adequate safety precautions before issuing that permit, and § 41-4 defines 'public purposes' to exclude any regular or scheduled flights, so the exception cannot be used to run a commercial air service.

Section 41-3 states the chapter's intent is to protect public well-being and safety by keeping private aircraft operations out of Town, and § 41-5 grandfathers uses the Town had already authorized before January 1, 1972. Violating the chapter carries a fine of up to $100 per violation under § 41-6. Separately, Chapter 78's general noise ordinance, cross-referenced at § 78-9, does not attempt to regulate aircraft noise directly: § 78-7G exempts noise created by certificated aircraft operating under Federal Aviation Administration control from the decibel limits set in § 78-5, leaving aircraft noise to federal regulation rather than the Town's noise-complaint process.
