Section 111-414(1) is written as an absolute rather than a preference: in no event shall any sexually oriented business be located within a 1,500 foot radius of the listed uses. Because the code says radius, the 1,500 feet is drawn as a circle in every direction across blocks and alleys, not measured along the route a person would walk or drive to get there. A site that is well over 1,500 feet away by road can still fall inside the circle.

The measurement runs property line to property line: from the nearest property line of a property developed with a sexually oriented business to the nearest property line of the school, church, hospital, day nursery, kindergarten school, park, residentially zoned area or other sexually oriented business. The location of the building on the lot does not help. A deep or oddly shaped Harlingen lot is measured from whichever corner comes closest to the protected use, even if the storefront itself sits far back from that line.

The protected list is broader than the usual school-and-church pairing in two ways. First, a residentially zoned area counts, so the zoning map controls rather than what has actually been built. Vacant land mapped residential still projects the buffer. Second, another sexually oriented business is itself on the list, so these uses cannot cluster into a strip in Harlingen: the first one lawfully established puts its own 1,500 foot radius in the way of the next applicant.

Harlingen pairs the distance rule with a special use permit rather than an over-the-counter license. The permit is renewed every two years, which gives the city a fixed point to look at police complaints tied to the address before it renews, and applicants go through a background check. Clearing the 1,500 foot radius is therefore necessary but not sufficient; the special use review still has to be passed.
