Kenai Peninsula Borough, AK Business Licensing & Operations: Adult Entertainment (2026)

Unlike many municipalities, the Kenai Peninsula Borough has never adopted a general sexually oriented business licensing chapter with spacing or distancing requirements; its only zoning treatment of the use sits inside KPB Chapter 21.44, the Local Option Zoning District (LOZD) rules that apply only where the assembly has approved a district after a parcel-owner petition. KPB 21.44.130(F) lists 'sexually oriented businesses' among the occupations that can never be approved as a home occupation in an LOZD's R-1, R-2, R-R, R-W or R-M residential zone, alongside vehicle repair, kennels, commercial composting and marijuana establishments as defined in AS 17.38.

Separately, KPB 21.44.190(D) prohibits sexually oriented business establishments outright in a C-3 mixed use LOZD, the borough's only LOZD zone that otherwise allows general commercial uses; that section also bars marijuana establishments and alcoholic beverage premises from a C-3 district. Because neither Chapter 21.44 provision creates a licensing or permitting pathway, an operator cannot cure the prohibition with conditions, a variance under KPB 21.05, or a conditional use permit; the use is simply not allowed anywhere an LOZD has been formed. Outside an adopted LOZD, College Heights, Keystone Estates, or the anadromous waters habitat protection district, the borough has no zoning code at all, so this specific prohibition does not reach the rest of the unincorporated Kenai Peninsula Borough; a sexually oriented business proposed there is not addressed by any borough land-use ordinance.
