Summary

In unincorporated Walker County, no one may operate an adult entertainment establishment, adult bookstore, theater, escort bureau or bathhouse/massage parlor meeting the sexual-activity definition without a County license under Sec. 22-327. The license requires clearing a 1,000-foot buffer from any residence, church, school, park, hospital, prison or alcohol-selling business.

These county ordinances apply to unincorporated areas of Walker County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Full Breakdown

Walker County Code § 22-327 creates a single licensing scheme covering adult bookstores, adult video stores, adult motion picture theaters and arcades, adult hotels/motels, escort bureaus, encounter centers, erotic dance establishments, and any 'bathhouse and massage parlor' whose services are characterized by an emphasis on specified sexual activities. No person may operate any of these businesses in the unincorporated county without first obtaining a currently valid County license; doing so, or continuing after a license lapses, is unlawful under subsection (c). Before a license issues, the proposed site must clear four separate 1,000-foot buffers measured from the center of the customer entry door: 1,000 feet from any residence; 1,000 feet from a church, school, government building, library, civic center, public park, hospital, community club or prison; 1,000 feet from any other adult-entertainment-type establishment; and 1,000 feet from any business selling alcoholic beverages.

Applicants must submit a surveyor's plat showing every parcel within those buffers along with its zoning and current use, and the site itself must already carry commercial zoning. Employees must be at least 21 years old, of good moral character, and individually permitted through the Planning and Enforcement Office, which vets them against a five-year criminal history covering prostitution, pandering, narcotics and other moral-turpitude offenses. Licenses run 12 months, are non-transferable, and require two consecutive weeks of newspaper notice plus an on-site sign before a License Review Board hearing. Minors are barred from the premises entirely, and no alcohol or drugs are permitted on site.

Violations & Fines

Operating an adult entertainment establishment, including a bathhouse or massage parlor meeting the section's sexual-activity definition, without a County license is unlawful and punishable under Walker County Code § 1-13. A license may also be suspended, revoked or placed on probation by the Planning Commission for violating the distance rules, employing unlicensed staff, admitting minors, or allowing prohibited sexual conduct on the premises; the County can also pursue injunctive relief and treat continued unlicensed operation as a public nuisance.

Frequently Asked Questions

How far must an adult entertainment business be from a home in Walker County?
Section 22-327 requires at least 1,000 feet between the customer entrance of an adult entertainment establishment and the nearest residential property line, measured as a straight-line radius. The same 1,000-foot buffer also applies to churches, schools, libraries, parks, hospitals and prisons.
Does Walker County require a license for a massage parlor?
Only if it meets the code's 'bathhouse and massage parlor' definition, an establishment offering physical contact services characterized by an emphasis on specified sexual activities. That definition falls under the adult entertainment licensing scheme in Section 22-327, not a separate massage-therapy license, and requires the same County license and 1,000-foot distance clearance as other adult businesses.
Can minors work at or enter an adult entertainment business in Walker County?
No. Section 22-327 sets 21 as the minimum age for both employees and licensees, bars admission of anyone under 21 to the premises, and makes it unlawful to sell or offer any adult entertainment service, material or device to a minor.
How long does a Walker County adult entertainment license last?
Licenses run for 12 months from issuance and must be renewed annually. A licensee who fails to open within 3 months of issuance, or who stops operating for 3 consecutive months, automatically forfeits the license with no refund of fees.
