(a)Any establishment that sells books, newspapers, videotapes, magazines, or other printed or written materials or any pictures, drawings, photographs, or motion pictures, which are distinguished or characterized by their emphasis on matter depicting, describing or relating to specific sexual activities or specific anatomical areas shall comply with the following requirements:(1)That any display of said material shall be shielded from public view and either placed behind a counter, at a height no higher than the top of the counter...

Sec. 62-314 requires any establishment selling material dominated by depictions of specific sexual activities or specific anatomical areas to shield it from public view, placed behind a counter, opaquely covered, sealed, or in a restricted-access room, and to keep it out of window displays visible from a public or private sidewalk. Access must be limited to persons 18 or older, restriction signage must be posted, and the display must sit away from the main entrance. Owners, operators and managers are liable for employee violations. The rule was adopted by Ord. No. 109-M, § 1, on May 21, 2001, and is enforceable by the police or building department.
