65(4). Subsection (d) bars any home occupation activity that uses heavy equipment, power tools, power sources or hazardous materials if the result is noise, vibration, smoke, dust, odors, heat, traffic, parking or other conditions exceeding, in duration or intensity, what a normal residential use produces, which in practice rules out engine work, bodywork, painting or fluid changes done with shop-grade tools at a residence. Subsection (b) separately bars all outdoor storage for a home occupation, including 'equipment stored on vehicles,' so a car or parts left outside for repair work does not qualify.
Subsection (h) limits any commercial vehicle associated with a home occupation to one vehicle not exceeding 10,000 pounds gross weight, nine feet in height, or 22 feet in length, which would exclude most tow trucks and larger service vehicles. 65(5) allows it to seek Process I review under Chapter 145 KZC, but the City can only approve it if the use will not create noise, odor, heat or glare that injures or endangers people on abutting properties, and will not require excessive outdoor storage of machinery or tools.
A repair business that cannot be screened from neighbors and stay within normal residential noise and traffic levels does not qualify at any Kirkland residence.
Violations & Fines
Running vehicle or engine repair work at a home in violation of KZC 115.65(4)(d)'s equipment and noise standards, or storing tools, parts or vehicles outdoors in violation of subsection (4)(b), is enforced under Chapter 1.12 KMC, Code Enforcement, with civil fines of $100 to $500 per day of noncompliance and possible revocation of the home occupation's business license.
