Hamilton, NJ Business Licensing & Operations: Secondhand Dealers (2026)

Chapter 273 of the Hamilton Code licenses dealers in precious metals, gems, jewelry and a long list of secondhand goods, including electronics, tools, cell phones, computers, cameras, gift cards and sporting goods, purchased from the public. Section 273-1 requires a license from the Municipal Clerk before anyone engages in the business, with licenses running May 1 to April 30. Under Section 273-4, the Clerk refers every application to the Division of Police and the Department of Community and Economic Development, which investigate the applicant's moral character and business responsibility within 10 days; a conviction for a crime involving dishonesty, fraud, deceit or misrepresentation triggers a recommended denial.

Dealers must also register with the Chief of Police, provide proof of zoning and construction permits, and show they own the computer equipment required for reporting. Section 273-6 requires every dealer to record each purchase on a numbered receipt and enter it into an electronic database within 48 hours, including a physical description of the seller, a full item description, the price paid, the seller's signature, and color photographs of the seller, the seller's ID and the items purchased. Section 273-5 requires the dealer to check identification and obtain a signed receipt from every seller. Section 273-9 requires a $10,000 surety bond payable to anyone defrauded by the licensee. Section 273-8 bars any purchase from a person under 18.
