Layton, UT Business Licensing & Operations: Secondhand Dealers (2026)

LMC 5.29.020 makes it unlawful to operate as a junk dealer or secondhand dealer in Layton without first obtaining a license and paying the $100.00 fee. Secondhand dealers must keep a well-bound book recording, at time of purchase, a true description of every article bought, the seller's name, age, address, height, weight and hair/eye color, the amount paid, and the date and hour, all in ink with no erasures, open to inspection by any police officer at any time (LMC 5.29.030); junk dealers keep an equivalent weight-and-material ledger (LMC 5.29.040).

Certain items, including televisions, stereos, video recorders, motor vehicle parts, firearms, jewelry, bicycles, fishing and boating equipment, trailers and musical instruments, are designated "receipt" items under LMC 5.29.010(4) and cannot legally be resold for at least 30 days after purchase without the Chief of Police's written consent (LMC 5.29.060). Dealers may not buy from anyone under 18 without a parent or guardian's written consent (LMC 5.29.070), and shops may not open for trade before 7:00 a.m., after 9:00 p.m., or on Sunday (LMC 5.29.080). Anyone storing junk or secondhand goods outdoors on a lot must enclose the storage area with a tight board fence at least five feet high, kept in good, sightly condition (LMC 5.29.090).

A numbered receipt must be issued for every purchase of a designated item, and for receipt items the seller must provide a legible right-thumb print plus a second form of ID on a signed ownership certificate (LMC 5.29.180).
