020(A) makes it unlawful to act as a tobacco retailer in Baldwin Park without first obtaining and maintaining a valid tobacco retailer's license for each location, and retailing without one is declared a nuisance as a matter of law. 030 sets eligibility limits: no license issues for retailing from other than a fixed location (foot or vehicle sales are prohibited), for a location exclusively zoned R-1, RG or R-3 residential, or for a location holding an on-sale alcohol license from the state ABC or offering food for on-premises consumption, meaning bars and restaurants cannot hold a tobacco license.

040 requires the application to name every proprietor, disclose the location's state tobacco license from the Board of Equalization, and list any violations from the past five years, filed with the Community Development Department. 060 sets the license term at one year, with renewal due at least 30 days before expiration. 070 makes a license nontransferable between persons or locations. 090 lets the City Council set the fee by resolution, calibrated to recover the cost of administration, inspections and prosecution, and the fee is nonrefundable. 100 requires compliance checks as often as three times per 12-month period, conducted by the Department or a peace officer.
