1.It shall be unlawful for any person to act as a tobacco product retailer in the City unless he or she has obtained a State and local tobacco license and maintains the same in full force and effect pursuant to this chapter for each location where tobacco product retailing occurs...4.It shall be unlawful for any person to sell any tobacco product without a license as mandated under this chapter, or with a suspended or revoked license. In addition, the Authority may impose civil penalties of up to $2,500.00 for each separate tobacco product sold during the period of non-compliance with this chapter...4.No licenses shall be issued for locations within 500 feet from youth populated areas. This restriction shall not apply to a tobacco product retailer within 500 feet from a youth populated area if it can demonstrate that it has been selling tobacco products in that location since April 20, 2020, or that the State of Colorado would otherwise grant a license pursuant to C.R.S. § 44-7-104.7(1)(b), as amended.

Violations & Fines
Selling tobacco products without a valid license, or with one suspended or revoked, exposes the seller to civil penalties of up to $2,500 for each separate tobacco product sold during the noncompliance period under § 8.08.030(A)(4). For a licensed retailer's own violations, § 8.08.130 sets guideline sanctions of a minimum $500 fine for one violation within 36 months, a minimum $1,000 fine for a second, and at least a 30-day license suspension for a third, with each day of violation a separate offense.
