Summary

Macon-Bibb County confines vape shops to the C-2, C-4, M-1, M-2 and SC zoning districts under Section 23.16.04, added in 2026 to curb youth exposure to vaping. A new vape shop must sit at least 2,640 feet, half a mile, from any other vape shop and from any school or facility that cares for children.

These county ordinances apply to unincorporated areas of Macon-Bibb County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Section 23.16.04. - Vape Shops. [1]Purpose. The purpose of this section is to regulate the location of vape shops so that such facilities do not become so concentrated and so close to facilities where youth tend to congregate that they increase unnecessarily the exposure of youth and others to vaping, in order to limit the negative effects of vaping, especially on youth.[2]Districts and Locations. Vape shops are allowed only in the C-2, C-4, M-1, M-2 and SC districts and only when they meet the following additional locational requirements:(a)Vape shops must be at least two thousand six hundred forty (2,640) feet from another vape shop,(b)Vape shops must be at least two thousand six hundred forty (2,640) feet from any educational facility or any facility for the care of children.

Full Breakdown

04, added to the Comprehensive Land Development Resolution by Resolution of January 12, 2026, singles out vape shops for their own zoning and spacing controls. The stated purpose is to keep vape shops from clustering near places where youth congregate, limiting the negative effects of vaping, especially on minors. Zoning is restricted to five districts: C-2 General Commercial, C-4 Highway Commercial, M-1 Wholesale and Light Industrial, M-2 Heavy Industrial, and SC Special Commercial. A vape shop is not a permitted use anywhere else in the county, including C-1 Neighborhood Commercial, the CBD-1 and CBD-2 Central Business Districts, or any residential or agricultural district.

Within those five allowed districts, two locational requirements apply on top of the district limit: a new vape shop must be at least 2,640 feet, exactly half a mile, from any other vape shop, and it must be at least 2,640 feet from any educational facility or any facility for the care of children, which sweeps in schools, day care centers and day care homes alike. Because the spacing rule is measured shop-to-shop as well as shop-to-school, a location that clears the school buffer can still fail if an existing vape retailer already occupies the half-mile radius, so an applicant needs a site survey confirming both distances before applying for a zoning permit.

The ordinance does not set separate retail licensing terms like fees or hours; it operates purely as a use and location restriction layered on top of whatever state tobacco and vapor product retailer registration Georgia law otherwise requires.

Violations & Fines

Operating a vape shop outside the C-2, C-4, M-1, M-2 or SC districts, or within 2,640 feet of another vape shop or a school or childcare facility, violates Section 23.16.04. Under Section 33.01, that is a misdemeanor the zoning enforcement officer can prosecute in Municipal or State Court, with each day of the violation a separate offense, and the Commission can deny or revoke the zoning permit.

Frequently Asked Questions

Where can a vape shop legally open in Macon-Bibb County?
Only in the C-2, C-4, M-1, M-2 or SC zoning districts. Section 23.16.04 excludes vape shops from every residential, agricultural, C-1 and downtown CBD district in the county.
How far must a new vape shop be from a school?
At least 2,640 feet, half a mile, from any educational facility or any facility for the care of children, measured under Section 23.16.04[2](b) of the Land Development Resolution.
Can two vape shops open near each other?
No. Section 23.16.04[2](a) requires at least 2,640 feet of separation between one vape shop and another, so a half-mile radius around an existing shop is off-limits to a new one.
