No person shall directly or indirectly keep for retail sale, sell at retail, or offer to sell or give away as free samples any licensed products without first having obtained a license to do so from the city.(b)The city shall have two types of tobacco licenses:(1)A tobacco products shop sales license; and(2)An accessory sales license. An applicant for an establishment that meets or is expected to meet the definition of a tobacco products shop in this section shall be required to obtain a tobacco products shop sales license. All other applicants shall be required obtain an accessory sales license. An application for either type of license shall be made to the city clerk on a form provided by the city and shall be accompanied by the annual license fee for each type of license as set forth in the city fee schedule. The fee is not returnable and shall not be prorated except as may otherwise be provided in this article.
