Pacifica, CA Business Licensing & Operations: Tobacco Retail License (2026)

01(h) to include not only cigarettes, cigars, pipe tobacco and chewing tobacco but any product or formulation containing biologically active amounts of nicotine manufactured, sold or distributed for introduction into the human body, other than products the FDA has approved to treat nicotine dependence, sweeping vaping and e-cigarette products into the licensing scheme alongside traditional tobacco. 02(a) makes it unlawful to act as a tobacco retailer at any location without first obtaining and maintaining a valid tobacco retailer's license issued by the Department, defined as the Pacifica Police Department, and declares unlicensed tobacco retailing a public nuisance in its own right.

Subsection (b) requires an unlicensed retailer, including one whose license was revoked, to keep all tobacco products and paraphernalia out of public view and bars any advertisement suggesting the products are available at that location. 01. 04 must be signed under penalty of perjury and disclose prior chapter violations within the previous six years. 09 requires positive identification of any buyer who appears under twenty-seven, bars self-service displays, and prohibits smoking within twenty feet of any door or window of the retail location. 10 directs the Police Department, Business License Department and Code Enforcement to check each licensed retailer's compliance at least twice per twelve-month period.
