Summary
In the City of Palm Desert, California, no one may act as a tobacco retailer without a valid tobacco retailer's license for each location. Licenses cover a fixed location only, run for a term of one year, and must be renewed no later than thirty days before expiration. Sales of electronic smoking devices are prohibited outright.
A. It is unlawful for any person to act as a tobacco retailer without first obtaining and maintaining a valid tobacco retailer's license pursuant to this chapter for each location at which that activity is to occur. No license may issue to authorize tobacco retailing at other than a fixed location. For example, tobacco retailing by persons on foot and tobacco retailing from vehicles are prohibited. No license may be issued to authorize sales of tobacco products at a temporary event, such as a festival or farmers' market. B. The payment of the license fee designated in Section 8.34.060 confers paid status upon a license for a term of one year. Each tobacco retailer shall apply for the renewal of his or her tobacco retailer's license no later than thirty days prior to expiration of the payment term. A license that is not renewed in a timely manner shall expire at the end of its term, and the tobacco retailer must obtain a new license prior to any further sale, offer for sale, or distribution of any tobacco product.
Full Breakdown
Chapter 8.34 of the Palm Desert Municipal Code requires a tobacco retailer's license for every location where tobacco retailing occurs. Section 8.34.020(A) allows a license only for a fixed location: retailing on foot or from vehicles is prohibited, and no license can authorize sales at a temporary event such as a festival or farmers' market. Section 8.34.060 leaves the fee to a city council resolution, calculated to recover no more than the cost of license administration and enforcement, and fees are nonrefundable except as required by law.
Applications go to the development services department in the name of each proprietor, on the department's form (Section 8.34.030). Applicants must disclose any past suspension or revocation and any violation findings within the previous five years, and an application is denied while any fines or late fees are outstanding. Section 8.34.040 directs the department to issue the license unless the application is incomplete or inaccurate, a suspension or revocation bars the proprietor, or the retailing is unlawful under the city code, including the zoning code. Tobacco sales are also prohibited in city-owned structures.
A license must be displayed prominently at the premises (Section 8.34.050) and cannot be transferred (Section 8.34.070). A new owner or a move to a new location requires a new license first.
Other license-linked limits in Section 8.34.020: no self-service displays, no coupons or multi-pack discounts, government photo identification to verify age twenty-one, and no sales by anyone under twenty-one. No new or renewed license issues for any pharmacy, and Section 8.34.020(J) prohibits selling electronic smoking devices that deliver nicotine or any other substance.
Violations & Fines
Under Section 8.34.090, a first violation within any sixty-month period brings a thirty-day suspension, a second brings ninety days, a third brings one year, and a fourth means permanent revocation. Unlicensed retailing draws administrative fines up to one hundred, two hundred and five hundred dollars, with each day a separate violation. Suspensions can be appealed to the city council within ten days.
