Full Breakdown
City Code Chapter 126, Article IX (Wrecker Services), Division 2 governs storage and reporting for towed vehicles. Section 126-416 explains the city council adopted the reporting requirement because vehicles towed and stored on private lots were later found to be stolen, and prompt reporting to the police department's auto theft division helps recover them faster. Under § 126-419, whenever a registered motor vehicle is towed and stored, parked, or left at a wrecker service lot for more than five days, the wrecker service owner must report in writing the make, model, VIN, license number, date of towing or storage, the person who authorized the tow, and that person's address and phone number, on a form the department furnishes; the report is due no later than five days from the date the vehicle was towed, unless there is a written continuous-storage arrangement with the vehicle owner.
Section 126-420 imposes a parallel five-day reporting duty for abandoned vehicles towed at a private citizen's request. Section 126-421 requires wrecker service owners to maintain adequate records describing each stored vehicle, the date it entered storage, and who authorized the storage, open to inspection by any law enforcement officer during normal business hours. Section 126-422 requires every vehicle a wrecker service uses for towing to bear, on each front door, permanently embossed lettering at least six inches high showing the wrecker service's name, address, and telephone number.
Violations & Fines
Under § 126-418, a wrecker service that fails to submit the reports required by § 126-419 forfeits all claims for towing and storage fees on that vehicle and is guilty of a misdemeanor punishable, upon conviction, by a fine of not less than $100.00 nor more than $1,000.00, imprisonment for up to six months, or both.
