On top of the towing bill, the city imposes an administrative fee, set at 25% of the maximum towing rate, on the registered owner or other person legally in control of a vehicle or vessel towed from public property, to cover enforcement costs including parking enforcement. The wrecker operator or towing business must collect that fee on the city's behalf and remit it to the city only after it has actually been collected from the vehicle owner, not in advance. The section was adopted by Ord. 2016-39 on January 26, 2016 and amended by Ord. 2021-50 on March 23, 2021, which added the administrative-fee mechanism now found at subsection (C).
Violations & Fines
Violating the towing-authorization rule in subsection (B) or the rate cap and fee-remittance duties in subsection (C) is punishable under the city's general penalty, § 10.99: a fine up to $500, imprisonment up to 60 days, or both, with each day of continuing violation a separate offense, capped so the local penalty never exceeds the comparable state-statute penalty. Overcharges or unremitted fees under subsection (C) also expose the operator to civil collection action, including referral for collections and litigation, independent of any criminal fine.
