Development Code Sec. 3.2.4.J.1.b sets a one-mile minimum separation, measured lot line to lot line, between a medical marijuana dispensary and a school or learning center serving children, a public library or park, a religious institution, a childcare center, an entertainment facility, a residential zoning district or use, or a residential substance-abuse treatment facility. The same one-mile list applies to off-site cultivation sites (Sec. 3.2.4.J.2.c) and dual-license establishments (Sec. 3.2.4.J.3.b). Before opening, the operator must also mail the Buckeye Police Department and every property owner within a 500-foot radius written notice identifying its on-site and security contacts.

Siting a dispensary or cultivation site inside a protected buffer, or skipping the 500-foot mailed notification, is a class one misdemeanor punishable by up to a $2,500 fine and six months in jail under Sec. 9.3.4.A.
