Full Breakdown

Section 34-726 of the Land Development Code applies to medical marijuana treatment center dispensing facilities and to pharmacies. For dispensaries, subsection (a)(1), headed Proximity, sets one distance: a facility may not be located within five hundred (500) feet of the real property that comprises a public or private elementary school, middle school, or secondary school. The sentence cites F.S. § 381.986(11)(c) as its basis. The buffer is measured to the real property of the school, which is the parcel, and not merely to the school building.

The section names schools only. It prints no separate distance from parks, churches, day cares or residential districts, and no other buffer appears in § 34-726(a). A separate buffer in the Code runs the other way: the standards for a certified recovery residence say it shall not be located within a radius of one thousand (1,000) feet of a medical marijuana treatment center dispensing facility.

Subsection (a)(2) sets hours. A dispensing facility may not operate between the hours of 9:00 p.m. and 7:00 a.m., as set forth in F.S. § 381.986(8)(f)(4). The section 34-300 definition limits the term to a facility or business operated by a medical marijuana treatment center or other organization holding all necessary state licenses and permits, where marijuana and products derived from it are dispensed at retail in accordance with all other applicable local, state and federal laws. The Planning and Development Department administers the Land Development Code, so proximity to a school is checked during zoning review.

Violations & Fines

A dispensing facility sited inside the 500 foot school buffer, or open between 9:00 p.m. and 7:00 a.m., violates § 34-726(a). Land Development Code violations are prosecuted before the special magistrate under § 34-1202: the Planning and Development Department gives a first notice with a minimum of ten (10) working days to correct, then a final notice of violation and a hearing. The City Council or any interested person can also seek an injunction in the Circuit Court of Duval County under § 34-1203.

Frequently Asked Questions

How far must a dispensary be from a school in Jacksonville Beach?
At least 500 feet. Section 34-726(a)(1) says a medical marijuana treatment center dispensing facility may not be located within five hundred (500) feet of the real property that comprises a public or private elementary school, middle school, or secondary school.
Is there a buffer from parks in Jacksonville Beach?
Section 34-726 prints no park distance. The only proximity sentence in that section covers elementary, middle and secondary school property. The Code's other mention of dispensary distance is a 1,000 foot limit on locating a certified recovery residence near a dispensing facility.
What hours can a medical marijuana dispensary operate?
A dispensing facility may not operate between 9:00 p.m. and 7:00 a.m., per § 34-726(a)(2), which cites F.S. § 381.986(8)(f)(4). Pharmacies carry the same 9:00 p.m. to 7:00 a.m. closing under subsection (b)(1), with an exemption for pharmacies operating legally before adoption.
Does Jacksonville Beach regulate recreational cannabis shops?
The Code sections reviewed address medical marijuana treatment center dispensing facilities and the definition in section 34-300. No separate provision for other cannabis retail is printed in the Jacksonville Beach Code of Ordinances export.
